I attended oral argument in LWV v Rokita this morning. Packed house. Tough questioning towards both sides. Karen Horseman-Celestino did a great job. Based on the questions, the justices are taking the case seriously and understand the issues. It seemed likely that the court could rule for the league on the article II claim. The court had questions about standing and whether this was a facial challenge. The court will probably rule on the merits, but could also just reverse the dismissal and require a trial so that there's more of a record.
